By becoming a member or using our Services, you accept and agree to these Terms and Conditions (“Terms”). Therefore, it is important that you carefully read through these Terms. If you do not consent to these Terms, you should not register with or use Holo.
Holo is a service in which you yourself can choose and tailor your own lifestyle protocol regarding diet, sleep, stress and exercise. Holo give some guidelines to which lifestyle changes may be good for you but you yourself choose what you want to do. Holo also give you tools and support to better follow the lifestyle changes you choose. The service is available online at: https://app.holo.health
Using our Services
To use our Services, you must follow some simple rules. The Service is only available for your private use and is not intended for commercial use. Do not misuse the Services, so that either you or anyone else is harmed in any way. You may only use the Services as permitted by law and these Terms. By using our Services, you agree that:
- All of the personal data provided by you is accurate and is not outdated.
- You are solely responsible for all activities on your account and all the content that is uploaded to Holo. Holo may at anytime choose to terminate your account.
- You are responsible for keeping your login details safe. Holo is not in any way responsible for any loss or damage caused by unauthorized access to your account or use of your login details. If you learn of or suspect any unauthorized use of your account, you must immediately inform Holo at: [email protected]
- Holo should not be used by persons under the age of 18. To use Holo, you must be at least 18 years old.
- Violation of any of these Terms will lead to a direct termination of your user account.
- You must not engage in any unlawful activities on the Service, such as (but not limited to) contributing with information which in any way contains or involves incitement to racial hatred, defamation, harassment, child pornography or pornography.
- You are not allowed to contribute to any propaganda, religious and/or political views.
- You may not transmit, and/or distribute files that may damage Holo or others’ computers or property such as viruses and similar software.
- You may not in any way share others’ personal information, without their approval.
You can at any time choose to cancel/end your account.
Health and nutritional information
Your health is your own responsibility and Holo takes no responsibility for it. Holo is a service that helps people potentially improve their health by changing diet and lifestyle. We are not a medical organisation, do NOT provide medical advice, and we urge you to follow any advice you receive from your doctor. When you follow Holo's protocol, your medications may need to be adjusted (just as with many types of diet and lifestyle changes) Holo takes no responsibility for how your medications are adjusted, or how they need to be adjusted, this should be done by your doctor or other licensed medical personel. Always consult your doctor before you make any major changes to your diet and lifestyle or if you feel discomfort, pain or anything else that may indicate a health issue.
Holo does not guarantee that the lifestyle changes contained in the service will lead to improvement of your health, nor does it assume any responsibility for the potential negative effects of the lifestyle changes suggested by the Service. Holo is not intended to treat, diagnose, or monitor diseases and other health conditions.
Note that Holo give you suggestions on different diets and lifestyle interventions to try, however, it is you yourself who choose what to do based on the information Holo provides and Holo therefore takes no responsibility for potential negative consequences of various the information given in the service.
One part of Holos services is a group chat where you can connect to other likeminded people and ask questions to ”coaches” (people who have followed the lifestyle changes in Holo for a longer time and have more knowledge). Holo cannot in any way guarantee that the information provided (either by the ”coaches” or the other group members) is accurate and Holo takes no responsibility for damage or other negative consequences from information provided in these chats.
Nutritional information found in our Service has not been verified, investigated or reviewed by Holo. Holo cannot guarantee that the nutritional information provided in our database is accurate, reliant or complete. Holo is not responsible for any personal injury or any other damages that may have been the result, direct or indirect, of any use or misuse of the Services.
All rights in and to the Services, including any trademarks, service marks, trade names and copyrighted content (collectively “Intellectual Property”) presented within the Service are the property of Holo and/or third parties. You agree not to use Intellectual Property for any other purposes except for your use of the Service unless required otherwise by applicable mandatory law.
Disclaimer and limitation of liability
You use the Service at your own risk. The Service is provided “AS IS,” without any warranties, and Holo does not warrant that the Service and availability thereof will be uninterrupted or error-free. Holo does not assume any responsibility for errors or omissions in the information or software or other documents. References or links to third parties' websites are provided "AS IS," without warranty of any kind, either express or implied.
In no event shall Holo be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence.
Governing law and dispute resolution
These Terms and the use of the Services are governed by the laws of Sweden, except for its conflicts of laws principles. All claims arising out of or relating to these Terms or the Service shall be resolved by the Swedish public courts, whereby the District Court of Stockholm shall be the court of the first instance.
This section only applies when you purchase and/or subscribe to Holo Premium. By paying the subscription fee you will be able to access Holo premium during the time your subscription is valid, subjected to these terms.
All subscriptions to Holo Premium are paid in advance.
You may at any time terminate your subscription. In that case your subscription will still be valid for the time you have already paid for. If you have subscribed to Holo in App Store or Google Play Store or any other equivalent service provider, using in-app-purchase, you can only terminate your subscription through the use of that service. The subscription fee for using Holo Premium can be found at: https://app.holo.health or in App Store and Google Play Store. Holo accepts many different payment methods such as Apple Itunes, Google Play, credit card payments and PayPal. Depending on the payment method you use different terms and conditions may apply. Holo may change the price of the subscription fee from time to time.
By subscribing to Holo Premium you consent to start using the Services immediately. This means that you will only have 14 days to withdraw from the subscription contract with Holo from the date you receive the confirmation of your subscription by email if you do not start using the services during that period. If you wish to exercise your right of withdrawal, you must contact Holo via email which can be found at the end of this document under contact details. Prepaid fees will be refunded within 30 days. Payments handled by Apple, for example in app purchases, can only be refunded by Apple and with Apple’s consent. If a user defaults in his or her payment this shall not be deemed as a termination of a Holo Premium subscription.
Holo offers people with limited funds the option to use Holo Premium for free. To do this the user must send an email to: [email protected] in which he or she describes why he or she cannot pay for the service. This email must be sent before subscribing to Holo Premium. In no case will Holo refund a user who has already paid for Holo Premium and after that date claim that he or she wants the service for free by email or any other means of communication. Holo reserves the right to deny a user free access to Holo Premium after the user requests it if it is not possible at that specific time or is not appropriate for any other reason. The user shall then be informed within 30 days.
